What exactly is a “pre-nuptial” agreement?
Many couples will have heard of the term “prenups” long before now. This is possibly because they will have heard the term used when describing many high-profile celebrity divorces.
The agreement should set-out what will happen to the couple's assets, such as the family home, if the couple were to divorce. The document can also stipulate how ongoing support should be provided as well.
A post-nuptial agreement is similar, yet the main difference is that this agreement should be freely entered while the couple is still married.
Will a pre- or post-nuptial agreement be legally binding?
It's important to note that neither a post-nuptial nor pre-nuptial agreement is legally binding.
Yet, at the same time, it's important not to dismiss entering such agreements out of hand.
The main reason is these agreements will be strongly considered by the Family Courts at the point of divorce.
However, for the courts to consider these agreements into consideration, the contracts must be correctly drafted, and both sides need to obtain legal advice before signing. Also, the agreements must be considered fair for both sides.
Take your time and consider the magnitude of what these agreements mean
Even broaching the subject to your partner, stating that you would like to enter into a pre-or post-nuptial agreement, can be a difficult subject to have.
Yet, even though it’s a difficult conversation to have, it's still very much worth having. As the old saying goes, it's “better to be safe than sorry”.
Once these agreements are entered into, the couple may feel a sense of relief and a burden has been lifted. That’s because if one partner is entering a marriage with considerably more in the way of assets, such as a family home, then often they will want enter into such an agreement.
