We see the same assumptions time and again. That there is such a thing as common law marriage. That everything is automatically split equally. That informal agreements are binding. That one parent is favoured over another. That conduct will determine the financial outcome. These are all understandable beliefs, but they do not reflect how the law operates in practice, and relying on them can lead to poor decision-making.
