Spousal Maintenance

During a divorce or the dissolution of a Civil Partnership there may be a need to continue to support your former partner financially.

This support can take the form of a lump sum payment, or for a series of ongoing payments to be made to support your partner. Occasionally a settlement may be reached which combines these two methods.It's important to note that spousal maintenance is different to child maintenance.

When does the need for Spousal Maintenance arise?

The need for spousal maintenance may be required by one partner, when they lack the financial assets or income to adequately meet their needs post separation.

For example, one partner might have sacrificed a career to bring up and care for the children.

That partner may therefore not be able, in the short term at least, to be able to support themselves financially.

What does a clean break actually mean?

It is generally felt that wherever possible that a financial clean break; upon divorce is the most suitable and certainly the preferred outcome for both parties.

However, simply ending your marriage and obtaining a Decree Absolute will not give you a financial clean break.

A clean break means all financial commitments to each other are ended. This can sometimes be achieved by one party paying the other a lump sum payment.

Some couples prefer a clean break as it can allow the parties to start afresh.
